We have a game where "Worn With Sorrow and Toil" was discarded, not because the FP declared, but because there were no more companions in the fellowship. While not strictly legal, it was fine.
But that's no longer the case, since it sticks around and armors Nazgul Search from Wind from the West. Correct?

On page 7 the rule about "play on the table" cards says that they are discarded when their play conditions are no longer met. While in this case the play preconditions are still met, the card's effects can no longer be applied, so it should be discarded.
I believe the purpose of this new rule is primarily to prevent the situation you are referring to - removing a completely useless card to shield a useful one from being discarded. I can't really think of any other reason to keep a useless card on the table.

While its a bit of a semantic stretch, that does seem reasonable, and I'll certainly play your recommended way barring overruling from above in the Chain of Command.

I agree that it is a "semantic stretch", but I believe that that is the spirit of the rule. Hopefully an FAQ entry will follow.

As written, the card would stay on the table, but that's lame.
I think it should essentially be errataed to have the precondition "Gollum is not the guide".

I'm with you. There's also another complication.
Worn With Sorrow and Toil should never hit against a compotent hobbit guide, since even in Mordor the hobbit seperates, rather than be taken directly as a casualty.
Of course, if the Free player feels like discarding cards, I suppose he could take a casualty...but that'd be stupid.
So if a hobbit guides is the card still on the table? icky.

I can think of two situations where it still matters with hobbits as guide. 1) Merry and Pippin in the Fellowship. We Shall Get It in play, and you don't want Gollum because of that. Shadow plays Foul Thing From the Deep drawing a 2. 2) Merry or Pippin in the Fellowship. Smeagol has not been drawn yet. Only when there are actually no companions left can Frodo stop being sad.
