I just re-read the scenario rules for retreating. You cannot retreat across fords or streams or into a region which is beside an enemy army, unless a friendly army is there. Here's the confusing part, "Even if these conditions are NOT met, the defending army can retreat into a free region chosen by the attacker, and then take one extra damage counter". So the conditions aren't met, but the defender decides he wants to retreat, the ATTACKER decides wether the defending army retreats accross the stream or in an empty region beside his own armies, and in either case the defender takes an extra damage counter. Am I reading this right or is this a typo?

You're reading it right. If the defending Army doesn't have a safe Region to which to retreat, the attacker decides where it will retreat to.
