Which-King and Merry & Eowin

When you draw the special Fate-Tile "Merry & Eowin" and Theoden is not on the Fate Track, the Which-King is killed.

Here my questions:

1. Has Theoden to be on the board or could he be killed before and the Fate-Tile still works?

2. Has the Which-King to be on the board (Position "2" has been choosen in the Shadow Phase)) or can he stay on the Position "1" or "3" to be killed?

1. It works as long as he has left the Fate Track, he can be dead or alive, it doesn't matter.

2. The Witch King has to be on the board to be killed. If he isn't the tile is reinserted to the Fate Pool and you draw another tile.
